Engineer IQBAL ZAFAR JHAGRA Versus FEDERATION OF PAKISTAN
ORDER
1. JAWWAD S. KHAWAJA, J .--- These two constitutional petitions (Constitutional Petition 33 of 2005 and Constitutional Petition 34 of 2005) have been filed by Engr. Iqbal Zafar Jhagra and Senator Rukhsana Zuberi. The petitioners have raised a number of issues about the pricing of petrol and natural gas which have a direct bearing with the enforcement of the fundamental rights of the people of Pakistan who have to bear the brunt of such prices.
2. Amongst other things, the petitioners allege that the price at which Compressed Natural Gas (CNG) is being sold to vehicle owners is not being determined in accordance with the law and is therefore inflated. There is no denying the fact that CNG prices have indeed increased over the last few years. According to figures provided by the Secretary, Ministry of Petroleum, in August 2008, CNG was being sold in Pakistan at the rate of Rs.33 per kg. Only four years later, in September 2012, it was being sold at Rs.95 per kg - almost three time the original prices. The number of citizens affected by this increase is also very large. According to figures provided by the Oil and Gas Regulatory Authority (OGRA), no less than 3395 licenses for CNG marketing have been granted. The number of users of CNG whether direct , or as poor commuters travelling on the roofs of buses, who depend on public transport is estimated to run into millions, and around 12% of the total gas in the national transmission system is devoted to the CNG sector.
3. While the petitioners have raised a number of issues, in the present order, we confine ourselves to only one: the pricing process for CNG. The Court did hear some arguments about the issue of pricing process of natural gas sold directly to consumers by SSGC and SNGPL and the impact of unaccounted for natural gas (UFG) losses on its determination. However, Mr. Abid Hasan Minto, Sr. Advocate Supreme Court, learned counsel for SSGC and SNGPL apprised the Court that the same issue was moot in writs filed before the High Courts of Sindh and Lahore. In the latter court, arguments have been concluded and the judgment is presently reserved. Mr. Minto therefore, requested that consideration of the issue relating to UFG losses be postponed to a date till at least one of the High Courts has pronounced its judgment. This suggestion has been made to enable all concerned to examine the reasoning which prevailed with the High Court. The suggestion being reasonable, we confine ourselves to the issue of CNG pricing, leaving the rest of issues for subsequent hearings.
4. It is clear from a review of the relevant laws that the primary responsibility for determining the sale price of CNG for consumers falls on OGRA. Rule 13 of the Compressed Natural Gas (Production and Marketing Rules), 1992 states that: "The Authority [OGRA] shall determine and notify the sale price in accordance with the policy guidelines issued by the Federal Government, from time to time. (2) No license[e] shall charge price from its consumer which is higher than the sale price notified by the Authority, [OGRA] from time to time."
5. It is correct, therefore, that the policy guidelines issued by the Federal Government are to be given consideration by OGRA. Section 21 of the OGRA Ordinance also states in similar vein that " the Authority [OGRA] shall comply with the policy guidelines [issued by the Federal Government] " If read out of context, these provisions could create the impression that in matters such as price determination, the Federal Government enjoys co-extensive powers with OGRA; or that, at least, its policy guidelines trump any other considerations which OGRA may have before it. However, this reading of the text runs against the overall scheme and text of the OGRA Ordinance. Policy guidelines are exactly what they purport to be i.e. guidelines at most. The statute envisages that the regulatory functions are to be performed by an Authority which is "independent in the performance of its functions", (S. 3(2)). This independence is actualized by laying down stringent objective appointment criteria of "eminent professionals of known integrity and competence" for key decision-makers (Section 3), vesting them with security of tenure ( S.3( 8) and S. 5) and funding OGRA through its own statutory fund (S.18). Clearly, all of these measures were taken by the legislature to provide OGRA with a strong measure of independence from the Federal Government. The measures would be rendered entirely superfluous if we construe section 21 of the Ordinance and Rule 13 in a manner which makes OGRA bound by the directives of the Federal Government. Since, the general principle of statutory interpretation is that the language of the legislature must not be rendered superfluous, we take it that that section 21 and Rule 13 imply only that OGRA must include the policy guidelines of the Federal Government in its consideration and decision-making process; it is not, however, bound by the same. That the legislature chose the term "policy guideline" instead of "directive" or "order ", corroborates this interpretation. We may also add that one of the principal raisons d'etre of OGRA as clearly spelled out in its statute is the protection of the consumer who ultimately is to bear the price of CNG.
6. Accordingly, we consider OGRA the primary bearer of regulatory power and have examined its exercise of this power. In our order dated 25-10-2012, we examined the breakup of CNG retail price submitted by OGRA. The same is also reproduced as under:--

7. We have concluded that various items in this formula appear to have been determined arbitrarily and not in accordanc/e with law and without any reference to the accounts of CNG stations. The operating cost of CNG Stations was, for instance, admittedly calculated "as per MoU signed b/w CNG Association & [Federal Government]". Upon examination, it turned out that the said Memorandum of Understanding dated 25th August, 2008 had been entered into by the Government of Pakistan and the All Pakistan CNG Association, CNG Dealers Association and CNG station owners. This MoU purported to fix the price of CNG in the whole country for a certain period and was "subject to revision, through identical consultative process between the parties, on bi-annual basis " ( clause e, MoU). Fixing the sale price of CNG in this manner represents a clear violation of the law. OGRA, which bears the primary responsibility in this area, was not even a party to the MoU. Yet, instead of intervening to protect the public interest, it simply chose to enforce the MoU. This constitutes a blatant abandonment of its duties and abdication of its statutory role as protector of the interests of the citizens who have to bear the brunt of unjustifiable prices. Essentially, this represents one of those sad episodes of our history where the cartel of suppliers, the government and the regulator came together to enact a grand exploitation of the poorest and most helpless amongst the country's citizens.
8. Taking notice of this situation, in our order dated 25-10-2012, we adjourned the matter "with direction to the Chairman OGRA to fix the price of CNG" in a fair, lawful and diligent manner. It may be reiterated that in that order the Court did not fix the price of CNG; it only referred the matter to OGRA and the Federal Government for ensuring due and proper pricing as commanded by law. Pursuant to that order, on the same date, OGRA determined a new price, vide S.R.O.------(I)/2012, which came to Rs.61.64 for Region I and Rs.54.16 for Region II.

In response to this second price formula, during the hearing on 1-11-2012, Mr. Wasim Sajjad and Mr. Abdul Hafiz Pirzada learned Senior Advocate Supreme Court entered appearance on behalf of the CNG licensees and sought two weeks time, which was granted. They contended that the price set by OGRA was too low and not commercially feasible. On 19-11-2012, OGRA submitted a report (C.M.A. No. 4762 of 2012) which suggested a new consumer price supported by a certain audit report. Adjourning the matter, the Court once again directed the "stakeholders [to] discuss amongst themselves and come up with an acceptable price formula, keeping in view the interest of all of them, particularly the consumers" as mandated by law.

During hearings on 4-12-2012, 5-12-2012 and 6-12-2012, OGRA contended that it could not come up with a satisfactory pricing formula since it had not received the audited accounts of licences, which would allow it to determine the various price items in a fair and informed manner. The Secretary, Ministry of Petroleum apprised the Court that the Federal Government, on its part, was yet to issue policy directions, but the matter would soon be taken up by the Economic Coordination Committee of the Cabinet. On 17-12-2012, OGRA submitted another report (C.M.A. No. 5189 of 2012) proposing a price of Rs.73.96 for Region I and Rs.65.52 for Region II. As late as the last hearing, i.e. 20-12-2012, neither had OGRA been able to come up with a fairly determined, evidence-based pricing formula, nor had the Cabinet issued any directions to resolve this long-standing dispute.
11. From the foregoing, it is clear that there are differing views prevalent about appropriate price of CNG. What has, however, been thrashed out in great detail, through these proceedings, is the process whereby OGRA is legally required to determine prices as well as the principles which it is supposed to apply during this process. OGRA, it may be reiterated, has been envisaged as an independent body which is supposed to protect the public interest. Its failure to protect ordinary consumers from oligopolistic and monopolistic activities cannot be condoned.
12. The learned counsel for OGRA candidly conceded that the earlier pricing formula did not meet the legal criteria as demanded by statute. In fact, this act of OGRA as well as various other practices represented gross violations of the law, resulting in the infringement of the fundamental rights of the people of Pakistan by extracting from them, unconscionable amounts for the unjust enrichment of the few. It may be recalled that in Muhammad Yasin v. Federation of Pakistan (PLD 2012 SC 132), the Court had taken note of the state of affairs at OGRA, striking down the illegal appointment of Tauqeer Sadiq as Chairman OGRA. In that judgment, the Court also took note of serious allegations of financial wrongdoings amounting to billions of Rupees, ordering NAB to investigate the matter. Those investigations are still going on. Whatever its state of affairs in the past may have been, OGRA is once again directed to discharge its duty in a legal and fair manner. A day-light assault on the fundamental rights of the people of Pakistan and their exploitation in violation of Articles 3 & 5 of the Constitution cannot be allowed to continue.
13. We reiterate that the determination of prices is a power vested by various laws on the executive functionaries and agencies of the State established under law. Consequently, the executive has also been equipped by the law with sufficient expertise and enforcement capability for this purpose. Our duty however, extends to reviewing the manner in which the executive exercises its powers and to see that the fundamental rights of citizens including the right to their hard earned income is protected. This has been highlighted in the judgment in the case of Muhammad Yasin supra. In the present case, through our order dated 25-10-2012, we exercised this power by striking down OGRA's pricing formula and directing it to prepare a new formula, in accordance with law. As the protector and enforcer of the fundamental rights of the people of Pakistan, the Court could not have done otherwise.
14. We note with great regret that throughout these hearings on issues of the greatest public importance, the approach of the executive authority which shares with OGRA the responsibility for sorting out this matter of highest significance, has not been helpful. In various hearings we were informed that the Federal Government is seized of this important issue and would take steps for its resolution. On 17-12-2012 we were again told that the Cabinet was to meet on 18-12-2012 and would takes decisions for resolution of the issue and also give policy guidelines. Yet, even as millions of CNG users continue to suffer because of the prevailing deadlock no guidelines were issued on 18-12-2012.
15. Since OGRA has still not been able to come up with a pricing formula based on evidence and in accordance with the prescribed process, it is directed once again to discharge its obligations in accordance with the law. It must do so in a swift manner, and after obtaining all necessary feedback from the stakeholders.
16. The questions relating to UFG losses and other issues raised in the Constitution Petitions will be considered at the next hearing.

114. 1۔ یہ آئینی درخواستیں C.P. 34/2005) اور (C.P. 33/2005 انجینئر ظفر اقبال جھگڑا اور سینیٹر رخسانہ زبیری کی جانب سے دائر کی گئی ہیں۔درخواست گزاران نے پٹرول اور قدرتی گیس کی قیمتوں کے تعین سے متعلق بعض ایسے سوالات اٹھائے ہیں جن کا تعلق براہِ راست عوام الناس کے بنیادی حقوق کے نفاذ سے ہے۔
115. 2۔ سائلین کی استدعاؤں میں ایک استدعا یہ ہے کہ انتظامیہ کی جانب سے سی این جی (CNG) کی قیمتیں جس طرح مقرر کی جاتی ہیں، وہ غیر قانونی ہے۔ اور اسی وجہ سے قیمتیں ناجائز حد تک بڑھ گئی ہیں۔ یہ حقیت ہے کہ گزشتہ چند سالوں میں گیس کی قیمتیں بہت تیزی سے بڑھی ہیں۔ سیکریٹری وزارتِ پٹرولیم کے مہیا کردہ اعداد و شمار کے مطابق سال 2008 ء میں سی این جی کی قیمت 33 روپے فی کلو تھی۔ صرف چار سال بعد ستمبر 2012 ء میں یہ بڑھ کر 95 روپے فی کلو تک پہنچ گئی۔ یعنی تقریباً تین گنا۔ قیمتوں کے اس اضافے کا اثر عوام کے ایک بہت بڑے حصے پر ہوتا ہے۔ تیل اور گیس کے ریگولیٹری ادارے ( اوگرا ) کی جانب سے مہیا کردہ اعداد و شمار کے مطابق سی این جی کی فروخت کے 3395 لائسنس جاری کئے جا چکے ہیں۔ اور سی این جی پر چلنے والی گاڑیوں کی تعداد لاکھوں میں ہے۔ اس سے بہت بڑھ کر تعداد اُن لوگوں کی ہے جو سی این جی پر چلنے والی بسوں اور ویگنوں پر سفر کرتے ہیں۔ ملک کی کل گیس سپلائی کا تقریباً 12% سی این جی پر صرف ہوتا ہے۔
116. 3۔ اگرچہ سائلین نے بہت سے معاملات میں داد رسی کی استدعا کی ہے، حالیہ آرڈر میں ہمیں صرف ایک مسئلہ سے سروکار ہے۔ اور وہ ہے سی این جی کی قیمتوں کے تعین کا طریقۂ کار۔ اگرچہ عدالت نے دیگر صارفین کو براہ راست فروخت ہونے والی گیس کے متعلق دلائل کی بھی سماعت کی ہے۔ خاص طور پر گیس چوری کے نتیجے میں عام صارفین پر پڑنے والے اثرات کا جائزہ لیا ہے۔ مگر گیس کمپنیوں کے فاضل وکیل جناب عابد حسن منٹو نے ہمیں بتایا کہ بعینہ یہی مسئلہ لاہور ہائیکورٹ اور سندھ ہائیکورٹ کے روبرو زیرِ سماعت ہے۔ اول الذکر عدالت میں تو دلائل مکمل ہو چکے ہیں اور فیصلہ آنے کو ہے۔ اس لئے منٹو صاحب نے درخواست کی کہ اس مسئلہ پر قلم اٹھانے سے پہلے فاضل ہائیکورٹوں کے فیصلے کا انتظار کیا جائے۔ تاکہ ہائیکورٹ کے فیصلہ کو بحث کی بنیاد بنا کر کوئی حتمی تصفیہ بمطابق قانون ہو سکے۔ یہ دلیل معقول ہے اس لئے ہم اس حکم میں خود کو سی این جی کے مسئلے تک محدود رکھیں گے۔
117. 4۔ متعلقہ قوانین و ضوابط کا جائزہ لینے سے واضح ہوتا ہے کہ سی این جی کی قیمتوں کے تعین کی ذمہ داری بنیادی طور پر اوگرا کے ادارے پر پڑتی ہے۔ سی این جی (مارکیٹنگ اور پروڈکشن) ضوابط، 1992ء میں لکھا ہے: اتھارٹی (یعنی اوگرا) وقتاً فوقتاً وفاقی حکومت کی جانب سے مہیا کردہ پالیسی خطوط کو مدنظر رکھتے ہوئے CNG کی قیمتِ فروخت مقرر کرے گی۔ (2) کوئی بھی لائسنس دار شخص صارفین سے مقررہ قیمت سے زیادہ وصول نہیں کرے گا ۔
118. 5۔ یہ درست ہے کہ اوگرا وفاقی حکومت کی جانب سے دی گئی پالیسی خطوط کو مدِنظر رکھے گا۔ اوگرا آرڈیننس کی دفعہ 21 میں بھی درج ہے کہ اتھارٹی (یعنی اوگرا) وفاقی حکومت کی جانب سے طے شدہ پالیسی خطوط پر عمل درآمد کرے گا ۔ اگر ان دفعات کو صحیح تناظر میں نہ پڑھا جائے تو ان سے یہ غلط فہمی پیدا ہو سکتی ہے کہ اوگرا قیمتوں کے تعین جیسے امور میں وفاقی حکومت کے فیصلوں پر عملدرآمد کا پابند ہے۔ یا کم از کم اس کے پیشِ نظر جو بھی اہداف و مصالح ہوں ان میں اہم ترین وہی ہوں گے جو وفاقی حکومت نے پیش کئے۔ ہماری رائے میں یہ تشریح درست نہیں کیونکہ یہ متعلقہ قانون کے متن اور روح سے متصادم ہے۔ پالیسی خطوط وضع کرنا اور بات ہے، قیمت کا تعین کرنا اور بات۔ پہلا اختیار حکومت کا ہے، دوسرا اوگرا کا۔ قانون کی روح واضح طور پر یہ ہے کہ اوگرا کو ایک خود مختار ادارہ ہونا چاہئے (دفعہ 3.2(2))۔ اس خود مختاری کو یقینی بنانے کی خاطر اہم عہدیداروں کی بابت پیشہ ورانہ قابلیت، امانت اور دیانت جیسی کڑی شرائط مقرر کی گئی ہیں۔ (دفعہ 3 ) اور اہم عہدیداروں کی مدتِ منصبی کو مکمل قانونی تحفظ دیا گیا ہے۔ 3(5) اور 3(8) میں ادارے کا خرچ اٹھانے کے لئے ایک علیحدہ فنڈ بنایا گیا ہے۔ (3(18)) قانون سازوں نے یہ تمام لوازمات اسی لئے وضع کئے تاکہ اوگرا وفاقی حکومت سے بڑی حد تک آزاد خود مختار رہے۔ اور وہ بغیر خارجی دباؤ کے اپنے گراں قدر فرائض خوش اسلوبی سے سر انجام دے۔ اگر ہم دفعہ 21 اور ضابطہ 14 کی تشریح یوں کریں کہ گویا اوگرا حکومت کے احکام پر عمل درآمد کرنے کا پابند ہے، تو یہ سب لوازمات بے معنی ہو کر رہ جائیں گی۔ ایسی تشریح، شرح قانون کے مسلمہ اصولوں کے خلاف ہو گی کیونکہ شرحِ قانون کا اصول تو یہ ہے کہ متن کو ایسے پڑھا جائے کہ اس کی کوئی شق اور کوئی لفظ بے معنی نظر نہ آئے۔ اس کلیہ سے ہم اس نتیجہ پر پہنچتے ہیں کہ اگرچہ اوگرا کی ذمہ داری ہے کہ وہ وفاتی حکومت کی جانب سے جاری کردہ پالیسی خطوط کو مدِنظر رکھے، مگر وہ اُن خطوط کی پابند نہیں بلکہ اُسے تو اپنا کام قانون کے مطابق اور عوامی مفاد میں کرنا ہے اور ہر قیمت پر صارفین کے حقوق کا دفاع کرنا ہے۔ قانون میں حکم یا آرڈر کے بجائے پالیسی خطوط کی اصطلاح کا استعمال بھی ہماری تشریح کی تائید کرتا ہے۔
119. 6۔ مختصراً یہ کہ قیمتوں کا ذمہ دار اوگرا ہے۔ عدالت اس بات کی مجاز ہے کہ اوگرا کے طریقۂ کار کا جائزہ لے اور یہ فیصلہ کرے کہ یہ طریقۂ کار قانون کے مطابق ہے یا نہیں۔ 25-10-2012 کے آرڈر میں ہم نے اوگرا کی جانب سے پیش کئے گئے اعداد و شمار کا جائزہ لیا تھا جن کی بنیاد پر اوگرا نے CNG کی قیمت کا تعین کیا تھا۔ جدول حسب ذیل ہے؟ CNG CONSUMER PRICE DETAILED BREAK UP.

232. 7۔ بنا بریں ہم اس نتیجے پر پہنچے تھے کہ اس جدول میں چند اعداد و شمار بلا جواز ہیں۔ مثلاً سی این جی اسٹیشن کے انتظامی خرچ کا تعین مالکان کے کھاتوں کی جانچ پڑتال کے بغیر کیا گیا۔ بلکہ مبینہ طور پر اس کا تعین وفاقی حکومت اور سی این جی مالکان کے مابین طے پانے والی ایک مفاہمتی دستاویز (MoU) میں کیا گیا تھا۔ اس دستاویز کا جائزہ لینے سے معلوم ہوتا ہے کہ 25 اگست 2008 ء کو حکومت اور سی این جی مالکان کے مابین یہ معاملہ طے پایا کہ سی این جی کی قیمتیں ایک خاص سطح پر متعین کر دی جائیں۔ یہ بھی طے پایا کہ آئندہ بھی اس طرح، اوگرا کی شمولیت کے بغیر، قیمتیں گاہے بگاہے طے کی جائیں گی۔
233. ظاہر ہے کہ حکومت اور مالکان کے مابین اس طرح گٹھ جوڑ سے گیس کی قیمتیں مقرر کرنا قانون کے قطعاً منافی ہے۔ ستم ظریفی یہ کہ اس مفاہمت میں اوگرا کو (جو اصلاً قیمتوں کے تعین کی ذمہ دار ہے) فریق بنانے کے لائق بھی نہیں سمجھا گیا۔ اور پھر، بجائے عوامی مفاد کے دفاع کی خاطر مداخلت کرنے کے، اوگرا اسی مفاہمت کا نفاذ کرانے لگا۔ یہ سرکاری اداروں کی جانب سے اپنے امانتی فرائض کی سبکدوشی کی ایک شرمناک مثال ہے۔ جس کا خمیازہ پاکستان کے غریب عوام کو کئی سال تک بھگتنا پڑا۔ ہماری رائے میں حکومت، سی این جی مالکان اور ریگولیٹر کا ایسا گٹھ جوڑ بے نوا اور غریب عوام کے استحصال کا اصل سبب ہے۔
234. 8۔ یہ وہ صورتحال تھی کہ جس کا مداوا کرنے کے لئے ہم نے 25-10-2012 کے آرڈر میں اوگرا کے چیئرمین کو حکم دیا کہ سی این جی کی قیمتوں کا صحیح اور قانونی طریقے سے از سرِ نو تعین کیا جائے۔ یاد رہے کہ اس آرڈر میں بھی عدالت نے خود گیس کی قیمت متعین نہیں کی تھی۔ بلکہ یہ معاملہ اوگرا اور حکومت کے سپرد کیا تھا تاکہ وہ قانوناً اس کا تصفیہ کریں۔ ہمارے حکم کے بعد، اوگرا نے اسی روز بذریعہ S.R.O.(1)/2012 قیمتیں از سرِ نو مقرر کیں۔ اب کے مقرر کردہ قیمت ریجن I میں 61.64 روپے فی کلو تھی۔ جبکہ ریجن II میں 54.16 روپے فی کلو تھی۔
235. 9۔ اس نئے قیمت نامے کے خلاف 1-11-2012 کی سماعت میں سی این جی مالکان کی جانب سے فاضل وکلاء جناب وسیم سجاد اور جناب عبدالحفیظ پیر زادہ نے وکالت نامے دائر کئے اور دو ہفتوں کی مہلت مانگی۔ اُن کی بنیادی استدعا یہ تھی کہ نئی قیمتیں اتنی کم ہیں کہ اُن پر گیس بیچنا کسی کو وارے نہیں کھاتا۔ 19-11-2012 کو اوگرا نے ایک رپورٹ (C.M.A. No.4762/2012) دائر کی جس میں ایک عبوری آڈٹ رپورٹ کو بنیاد بنا کر نیا قیمت نامہ تجویز کیا گیا۔ یہ قیمت نامہ بھی ٹھوس شواہد پر مبنی نہیں تھا اور ناقابلِ قبول تھا۔ اس لئے عدالت نے مقدمے کو پھر ملتوی کرتے ہوئے حکم دیا کہ متعلقہ فریق آپس میں مشاورت سے ایک قابل قبول قیمت نامہ پیش کریں، جو سب کے مفادات، خاص کر صارفین کے مفادات کا کماحقہ تحفظ کرے ۔
236. 10۔ 5-12-2012, 4-12-2012 اور 6-12-2012 کی سماعتوں میں اوگرا ایسا کرنے سے قاصر رہی۔ اس کا عذر یہ تھا کہ لائسنس داروں نے اپنے آڈٹ شدہ کھاتے جمع نہیں کرائے۔ ایسے کھاتوں کی جانچ پڑتال کے بغیر شواہد پر مبنی قیمت نامہ مرتب نہیں کیا جا سکتا۔ اسی طرح حکومت کی جانب سے سیکریٹری پٹرولیم نے یہ عذر پیش کیا کہ حکومت اب تک تو پالیسی خطوط کا اعلان نہیں کر سکی، مگر کابینہ کی معاشی تعاون کمیٹی (ECC) عنقریب اس معاملے پر توجہ دے گی۔ 17-12-2012 کی سماعت میں اوگرا نے مزید ایک رپورٹ (C.M.A. No.5189/2012) پیش کی جس میں ایک بار پھر نیا قیمت نامہ تجویز کیا گیا۔ اس قیمت نامہ میں ریجن I میں قیمت 73.96 روپے فی کلو اور ریجن II میں 63.52 روپے تجویز کی گئی ہے۔ مگر آخری سماعت یعنی 20-12-2012 تک بھی اوگرا ایسا قیمت نامہ پیش نہیں کر سکی ہے جو تمام قانونی تقاضے پورا کرتا ہو اور ٹھوس شواہد پر مبنی ہو۔ اور نہ ہی کابینہ نے اس گھمبیر تنازعہ کے حل کی خاطر کوئی پالیسی وضع کی۔
237. 11۔ اس سیاق و سباق سے یہ واضح ہوتا ہے کہ سی این جی کی مناسب قیمت کے بارے میں ملک میں کئی مختلف آراء پائی جاتی ہیں۔ ان سماعتوں میں جس چیز کا تعین کر دیا گیا ہے، وہ ایک قانونی طریقہ کار ہے کہ جس کے مطابق اوگرا نے قیمتوں کا حتمی تعین کرنا ہے۔ مزید برآں اس طریق کار کے پیشِ نظر جو آئینی اور قانونی اصول ہیں، وہ بھی اس مقدمے میں ابھر کر سامنے آ گئے ہیں۔ ہم دہرائے دیتے ہیں کہ ان اصولوں پر عملدرآمد کی ذمہ داری اوگرا کی ہے۔
238. 12۔ سماعت کے دوران اوگرا کے فاضل وکیل نے خود بھی اعتراف کیا کہ ماضی میں قیمتوں کا تعین جس انداز میں کیا جاتا رہا، وہ غیر شفاف تھا۔ بلکہ اوگرا کا یہ عمل، اُس عہد کے دیگر کئی اقدامات کی طرح، صریحاً قانون کے خلاف تھا۔ اور قانون شکنی کی اُس ریت کا عکاس تھا جو اس اہم ترین ادارے میں رائج رہی۔ اور جس کا نتیجہ یہ نکلا کہ عوام کے بنیادی حقوق مجروح ہوئے اور چند لوگوں نے اپنی جھولیاں بھریں۔ یاد رہے کہ محمد یاسین بنام وفاق پاکستان (PLD 2012 SC 132) کے مقدمے میں اسی عدالت نے توقیر صادق کو بطور چیئرمین اوگرا تقرری کو کالعدم قرار دیا تھا۔ اور اربوں روپے کی خرد برد کے الزامات کے سلسلے میں نیب کو تحقیقات کا حکم دیا تھا۔ وہ تحقیقات تاحال جاری ہیں۔ بہرحال یہاں یہ کہنا مقصود ہے کہ ماضی میں اوگرا میں جو بھی حالات تھے، اب ہم اوگرا سے یہی توقع رکھتے ہیں کہ وہ اپنے فرائض قانونی انداز میں نبھائے گا۔ آئین کے آرٹیکل 3 اور 5 کے منافی عوام کے استحصال کا یہ سلسلہ ہمیں کسی طور بھی قابل قبول نہیں۔
239. 13۔ ہم یہاں اس بات کا بھی اعادہ کرتے چلیں کہ قیمتوں کے تعین کے اختیارات قانون نے انتظامیہ کے مختلف اداروں کو دئیے ہیں۔ اُن اداروں کو پیشہ ورانہ سوجھ بوجھ کے حامل افراد کی خدمات مہیا کی گئی ہیں۔ اور آ ہنی ہاتھوں سے قیمتوں کے نفاذ کا نظام بھی دیا گیا ہے۔ ہمارا اختیار تو صرف اسی قدر ہے کہ انتظامی ادارے جس انداز میں اپنے اختیارات استعمال کرتے ہیں اُس کا جائزہ لیں۔ یہ اصول محمد یٰسین کے مذکورہ بالا فیصلے میں بھی واضح کیا گیا ہے۔ اس مقدمے میں بھی، 25-10-2012 کے آرڈر میں ہم نے اسی اختیار کو استعمال کرتے ہوئے اوگرا کے قیمت نامہ پر اعتراض کیا تھا اور اوگرا کو ہدایت کی تھی کہ وہ قانونی انداز میں نیا قیمت نامہ مقرر کرے۔ عوام کے حقوق کے نفاذ کی خاطر اس قدر کرنا تو عدالت کا فرض تھا۔
240. 14۔ یہ افسوسناک امر ہے کہ ایک انتہائی اہم مقدمے میں وفاقی حکومت کی جانب سے جس قسم کا تعاون درکار تھا، وہ ہمیں نہیں ملا۔ متعدد سماعتوں کے درمیان ہمیں یہ باور کرایا جاتا رہا کہ وفاقی حکومت اس اہم اور گھمبیر مسئلہ سے نبرد آزما ہے اور اس کے حل کے لئے عنقریب ایک ہمہ جہت پالیسی پیش کرے گی۔ 17-12-2012 کو ہمیں بتایا گیا کہ اگلے ہی روز کابینہ کے اجلاس میں اس موضوع پر بحث ہو گی اور اہم فیصلے کئے جائیں گے۔ باوجود اس کے کہ آج تک کئی لاکھ سی این جی صارفین آج تک قطاروں میں کھڑے مسیحائی کا انتظار کر رہے ہیں، کوئی پیش رفت سامنے نہیں آ سکی۔
241. 15۔ چونکہ اوگرا ابھی تک شواہد پر مبنی اور قانونی طریقِ کار سے مرتب کردہ کوئی قیمت نامہ پیش نہیں کر سکی، اُسے پھر حکم دیا جاتا ہے کہ وہ اپنی قانونی ذمہ داریاں ادا کرے، جلد کرے اور تمام فریقوں کی رائے کو درخوار اعتنا لاتے ہوئے کرے۔
242. 16۔ ان آئینی درخواستوں میں اُٹھائے گئے دیگر مسائل مثلاً گیس چوری (UFG losses) وغیرہ کا احاطہ آئندہ سماعتوں میں کیا جائے گا۔
