BROOKES PHARMACEUTICAL WORKERS' UNION, KARACHI Versus UNION OF BROOKES PHARMACEUTICAL EMPLOYEES, KARACHI

DECISION

There has been a spate of litigation between the various unions of the workers of the Brookes Pharmaceutical Ltd., some of whom have been duly registered, and the others are awaiting registration. They have gone to all the forums available i.e. the Labour Court, this Tribunal, the Civil Courts and twice to the High Court of Sindh under the writ jurisdiction.

2. Almost an identical dispute, as the one in question, is the subject matter of a writ petition before the High Court. It was fixed some three/four days earlier and was adjourned to 30th instant when the attention of the Hon'ble Court was drawn to the fact that the present application was to come up before this Tribunal on the 26th of August, 1992.

3. I have heard Mr. S.P. Lodhi and Mr. Hameed Siddiqui. The contentions raised before me were factual in nature‑‑the arm‑twisting behaviour of the workers by the management, to have a pliant union determined as the Collective Bargaining Agent in the referendum.

4. The instant application is only an information laid before this Tribunal and does not lie as a matter of right. Looking to the circumstances of the dispute I will be extremely reluctant to exercise the suo motu jurisdiction vesting in this Tribunal.

5. As a result the application stands dismissed.
