HABIBULLAH Versus MINNOO HOTEL, KARACHI

DECISION

The petition filed by the appellant was dismissed mainly on the ground that the provisions of the Standing Orders Ordinance, 1968 were not applicable to the respondent hotel.

2. There is merely the word of the appellant with the assertion that there were more than 20 workers employed in the hotel. He has filed a photostat copy of the alleged Payment Register but there is no indication from anywhere as to whether it pertained to the hotel in question.

3. As against this the respondent has produced the Social Security record of the hotel from January 1986 to December 1990 which clearly indicates that at no time during all this period the number of employees ever reached 20. There is also the evidence of Amiruddin Channa, the Deputy Director of the Social Security Directorate, 'Karachi who had brought the record in respect of the number of the employees in the hotel of the respondent which was only 12.

In this view of the matter there is no merit in the appeal. I will therefore dismiss the appeal summarily.
