LABOUR UNION (REGD.) UNITED BANK LIMITED Versus REGISTRAR OF TRADE NIONS

Parties to this Constitution petition, are in attendance. After stating their case for a considerable time, these parties have seen the rule of sanity. All of them agree that this petition be disposed of in accordance with the settlement which will be described in next paragraph.

2. Labour Union Registered UBL Farid Gate, Bahawalpur (through its President Rao Ghulam Mustafa Khan) herein petitioner was allowed certificate of registration by the Registrar, Trade Unions, Bahawalpur on 4‑10‑1988. Employees Union Registered Bahawalpur Zone UBL Bahawalpur herein respondent No. 3 was registered by the relevant authority on 21‑5‑1973. It had been functioning as a CBA on account of being sole Union in the field. One more Union, namely, Employees Union Registered, Bahawalpur Zone UBL (Punjab) was registered by the Registrar of Trade Unions, Lahore on 24‑9‑1988. Against this order, petitioner had invoked the Constitutional jurisdiction of this Court.

3. All the parties agree that the certificate of registration of last named Union be cancelled. This Union was impleaded as a party by me vide order dated 23‑5‑1992. The President and the General Secretary of this Union are in attendance. They state that the registration of this Union be cancelled. The parties further concur that Registrar, Trade Unions, Bahawalpur be directed to hold referendum under the provisions of Industrial Relations Ordinance, 1969, so that the credential of competing Unions be fully established. Assistant Director, Trade Unions, Bahawalpur is present. He states that the moment an application is put to Department by an aggrieved Union for holding referendum, Registrar, Trade Unions, Bahawalpur will arrange the holding of referendum strictly in accordance with law. Till then the CBA Union shall continue functioning as CBA. The petitioner undertakes to put up the application to Registrar, Trade Unions for holding agreed referendum as soon as possible.

4. Resultantly with the concurrence of the parties, the Registrar, Trade Unions, Bahawalpur is directed to hold referendum the moment he receives the application from petitioner. He shall arrange the holding of referendum strictly in accordance with law. This petition in aforesaid terms stands disposed of with the consent of all the parties
