SITWAT HUSSAIN Versus NATIONAL BANK OF PAKISTAN, KARACHI

1. IMAM ALI G. KAZI, J: ‑ ‑The petitioner in this case is an employee of National Bank of Pakistan. He has filed this petition under Article 1.99 of the Constitution of Islamic Republic of Pakistan, 1973 with a prayer that "this Hon'ble Court may be pleased to issue writ of Mandamus directing the respondent i.e. National Bank of Pakistan to promote the petitioner in Officer Grade‑II with effect from 1‑1‑1989 and grant with all back benefits."

2. This petition is not maintainable for the simple reason that promotion to a particular post is not a vested right.

3. On the last date of hearing pre‑admission notice was ordered to be issued to the respondent. Mr. Bilal A. Khawaja, Advocate is present in Court on behalf of the respondent today and he has drawn our attention to Annexure `F filed by the petitioner which clearly indicates that the case of promotion of the petitioner was considered by the National Bank of Pakistan and that the petitioner filed a Review Petition before the respondents to reconsider his case. Mr. Bilal A. Khawaja Advocate states that his ‑ application will be processed in due time and the result intimated to the petitioner.

ORDER

4. For the foregoing reasons, this petition is dismissed in limine.
