MUHAMMAD ANWAR Versus WAZIR.

In the above‑noted three cases the orders passed by the learned Judge, Small Causes Court, Karachi whereby he issued distress warrants against the petitioners are challenged. The petitioners before the lower Court disputed the identity of the properties in respect whereof distress warrants were issued by the Court. After I heard the learned counsel for the parties at length they agreed to the disposal of the above noted three Revision Applications in terms of the following order:‑‑

1.That the petitioners who are alleged to be the tenants of the property occupied by them respectively shall deposit the amount of distress warrants within one month from today without prejudice t A their contention that they are not the tenants of the respondents in respect of the premises in dispute.

2. That the amount so deposited by the petitioners in Courts shall not be paid to the respondent until such time the relationship between the parties are determined either in the rent proceedings which are pending now before the Rent Controller or in some other appropriate proceedings.

3. There will be no order as to costs. The three Revision

Applications are disposed of accordingly.
