ORDER

1. A. HADI KHOSO, J .---Learned counsel for the petitioner has filed this application, praying therein exemption of petitioner from filing surety as per rules as this SMA was allowed on 4-2-2010 in favour of the petitioner. Learned counsel submits that being legal heir of the deceased and old aged person despite his best efforts the petitioner could not arrange the surety, hence letter of administration may be issued without furnishing surety, on personal bond of the petitioner.

2. The main ground of the petitioner is that he despite could not arrange the surety as per rules. The property mentioned in the schedule is of approximately Rs. 1,25,00,000 and property, the petitioner cannot be exempted from furnishing surety. It is, therefore, ordered that original documents of the property involved in the SMA be deposited with the Nazir of the Court as a surety and a personal bond also be executed by the surety for issuance of letter of Administration.
