SHABBIR AHMAD Versus STATE

ORDER

This is a petition under section 561-A , Cr. P. C . by Shabbir Ahmad, petitioner, for the quashment of a case pending against him and some others under section 419/420/467/468/471, P.P.C., and section 5(2) of the Prevention of Corruption Act at Police Station Anti-Corruption Establishment Kasur on 9-4-1976.

2. On behalf of the petitioner it is submitted that -his name does not appear in the F.I.R. There is no evidence against the petitioner to connect him with the crime in instance.

3. The transactions relate to the period when the petitioner was al Patwari and the case relates to a forged allotment made during his period through an entry in the R.L. II register in the relevant Khata. The body of the writing is apparently that of Shabbir Ahmad, petitioner, and the signatures under the forged allotment are of officers who have deposed to their signatures being forged. The Ziminis show that there is sufficient evidence against the petitioner to show that prima facie he is guilty of the offences charged. In these circumstance, no case of quashment is made out. This petition is dismissed in limine.

4. The challan file shall now be sent to the Special Judge, Anti -Corruption, Lahore, so that he may proceed with the case and dispose it of at an early date. Since the case is a very old one, he shall endeavour to finalize the same within this year.
