ORDER

1. Criminal Miscellaneous No. 2525/B‑83 and Criminal Miscellaneous No. 2524/B of 1983 are connected in the sense that these are applications for cancellation of bail allowed to the respondents who are all accused in a case under section 302/307/326/148/149, P.P.C. registered against them on 27‑6‑1981 at Police Station Bhera, District Sargodha. The respondents were arrested on 8‑7‑1981 and on 17‑7‑1981 and the challan was put up on 23‑8‑1981 But the record indicates that their trial did not commence until 29‑5 1983 after a lapse of about one year and ten months. The trial which appears to have commenced from 29‑5‑1983 somehow or the other remained pending either because learned counsel for the respondents asked for an adjournment or the trial Judge could not proceed with the matter and it is still pending. Anyway, on 24‑9 ‑1983, the Additional Sessions Judge, Sargodha, by two orders admitted the respondents to A bail on the technical ground that since more than two years had elapsed and the trial had not yet been concluded, therefore, he allowed them bail. As I have pointed out above, these are petitions for cancellation of bail allowed to the tee. respondents I have enquired from learned Assistant Advocate‑General as to which is the next date fixed for the trial of the respondents by the trial Judge. He states before me that it is 29‑11‑1983. The matter at present is stated to be pending before Mian Muhammad Anwar Nasim, Additional Sessions Judge, Sargodha. I am not inclined to cancel the bail allowed to the respondents at this stage but learned Additional Sessions Judge is hereby directed to proceed with the trial of the respondents by day‑‑to‑day hearing and to dispose it of before 31‑i2‑1983. Both the petitions are disposed of.
