SYED SAMAD ALI Versus SYED RIAZ ALI

This petition under Article 199 of the Constitution of the Islamic Republic of Pakistan, 1973 has been riled by M/s. Al‑Khair Trust which claims to be a Welfare Society formed to promote education and is registered under the Societies Act, 1860.

The main grievance of the petitioner as disclosed in this petition is that though it had applied for grant of affiliation under section 35 of the University of Punjab Act, 1973 on 18th February, 1990 so as to enable it to start post‑graduate classes in the institution being run by it, the said application has not been decided to the prejudice of the petitioner and the students studying therein.

3. Ch. Muhammad Farooq, learned Legal Advisor of University of Punjab is present alongwith the relevant record from which he points out that the application for affiliation was not filed on 18th February, 1990 as alleged but on 2nd of July, 1991. The learned counsel has further submitted that as per the requirement of section 35 of the Act and the statute framed by the University on the subject, the University is required to examine different aspects of the matter and then decide the application which perforce takes time. He states that the application of the petitioner is being processed without any delay.

4. It was also pointed out by Ch. Muhammad Farooq, Advocate, that the petitioner was called upon vide letter, dated 24‑9‑1991 by the University to supply certain informations and proof regarding its financial stability but that letter had remained unanswered till today. Rana Muhammad Sarwar, learned counsel for the petitioner states that he has no information about that letter.

Be that as it may, this petition is disposed of with the direction that the application filed by the petitioner shall be decided by the University of Punjab within a month from today. The petitioner shall forthwith supply the requisite information to the University and in case of its failure to do so, the University may decide the matter without affording any further opportunity.

This petition is disposed of in the above terms with no order as to costs.
