MST. SARTAJUN NISA Versus MUHAMMAD ISHAQ

Mr. 'Muhammad Akhtar, learned Additional Advocate‑General accompanied by Mr. Muhammad Iqbal Vehnival, learned counsel, on Court's call is present. He has been heard. It has been brought to the notice of the Court that respondents 2 to 12 have been served with a notice sent to them by this Court. They are not present in Court despite call. They are, therefore, proceeded ex parte.

2. Learned counsel for the parties have themselves resolved the controversy by entering into a compromise. Mr. Abdul Aziz Qureshi, learned counsel for respondents 13 to 15 states at Bar that in case a direction is given to the respondent Notified Officer for allotment of evacuee land against their verified claim, they will have no objection if the land in possession of the petitioners is allowed to remain with them. This offer has been accepted by Ch. Muhammad Anwar Bhinder, learned counsel. Mr. Muhammad Akhtar, learned Additional Advocate‑General has also no objection if the direction asked for is issued in the case. In the circumstances, the land held by the petitioners shall remain with them. However, a direction is given to respondent department to allot evacuee land to the contesting respondents after making close scrutiny to the genuineness or otherwise of their claims, within two months. With these remarks, this petition is disposed of in terms of the compromise entered into by the learned counsel for the parties. There shall however be no order as to costs.
