MUHAMMAD HASSAN Versus THE STATE

1. This is an application under section 24 of the C.P.C. seeking transfer of a suit filed by the petitioner against the respondent which is pending in the Court of Mr. Zafar Iqbal, Civil Judge, Lahore. The prayer is that the suit be tried by this Court in the exercise of its, original jurisdiction on the ground that respondent No.1 is working as Additional District Judge, Lahore and it would be difficult for the trial Court to decide the matter impartially.

2. No one has appeared 6n behalf of the respondents to contest this application. I think the ends of justice should be served if the suit is withdrawn from the Court of Civil Judge and is entrusted to the Court of District Judge. Lahore for its trial.

2. As a result of what has been stated above the suit titled "Saeeduddin Naqvi v. Muhammad Afzal Javed and another" is withdrawn from the Court o: Mr. Zafar Iqbal, Civil Judge, Lahore and is entrusted to the Court of District Judge, Lahore for its trial in accordance with law.

3. No order as to costs.
