NOOR MUHAMMAD Versus S.H.O.

Pursuant to order, dated 28‑3‑1992, Senior Superintendent of Police, Bahawalpur has had the matter inquired into from D.S.P., Hasilpur and latter's report has been received in this Constitutional petition praying for the issuance of a direction to S.H.O. Police Station Khairpur Tameywali against private respondents herein. It has been reported that Mst. Zaibo Mai, daughter of Noor Muhammad ‑ petitioner, was . married to Allah Bachaya son ‑ of Muhammad Ramzan real brother of Noor Muhammad petitioner and petitioner's son, Bashir Ahmed, was married to Mst. Allah Bachai daughter of Muhammad Ramzan. Subsequently, the parties could not pull along and both the marriages were dissolved in 1989. Mst. Zaibo Mai contracted marriage with Karim Bakhsh son of Allah Bachaya respondent No.2 herein and the allegations of abduction as well as of theft levelled by the petitioner against Karim Bakhsh and .others, are incorrect. Statements of Noor Muhammad petitioner, Allah Bachaya son of Muhammad Ramzan, Rao Muhammad Farooq son of Mumtaz Ali, Mst. Zaibo Mai, Karim Bakhsh son of Allah Bachaya, Mehr Fateh Muhammad son of Mehr Muhammad Hayat son of Turab Ali and a certificate issued by the Chairman and Secretary, Union Council, Lal Sohanra, Tehsil Hasilpur dated 9‑4‑1992 to the effect that Talaq pronounced by Allah Bachaya son of Muhammad Ramzan upon Mst. Zaibo daughter of Noor Muhammad on 9‑3‑1989 became effective thereafter, have also been appended to the report by the D.S.P., Hasilpur.

Learned counsel for the petitioner has simply contended that as there was some material available with D.S.P., Hasilpur supporting the case of the petitioner, the report is incorrect and a direction to the respondent S.H.O., Police Station Khairpur Tameywali to register a case, is the only remedy available to his client in this matter. I am afraid the contention has little merit. The allegations in the petition were got inquired into by this Court from Senior Police Official and the result of the enquiry has gone against the petitioner. In this view of the matter, no useful purpose will be served by issuing the direction prayed for in this petition. If the petitioner feels dissatisfied with the result of the enquiry, he can, if so advised, file a complaint before the appropriate forum.

With the above observation, this petition stands disposed of.
