MUHAMMAD HANIF Versus STATE

ORDER

The petitioner Muhammad Hanif is seeking bail after arrest in case F.I.R. No.73 of 1995 dated 13‑8‑1995 registered at Police Station Fetah Shah, Vehari under section 302/148/149, P.P.C. at the instance of complainant Khizar Hayat, the brother of the deceased Umar Hayat.

2. The petitioner was arrested on 22‑8‑1995, investigation has been completed and challan has been submitted but the trial has not been commenced as yet.

3. The petitioner is not attributed any injuries to the deceased and the only allegation against the petitioner of having crossed the tractor over the dead body of the deceased is not supported by the medical evidence.

4. I have heard the learned counsel for the petitioner, State and have also perused the record.

5. In these circumstances the application is allowed and the petitioner is granted bail subject to his furnishing bail bonds in the sum of Rs.1,00,000 (rupees one lac only) with one surety in the like amount to the satisfaction of the trial Court.
