Mst. KHURSHID JEHAN Versus Mst. ALIA BANG

1. I have heard Mr. A.Q. Malik Advocate for the appellants and Mr. Iqbal Ahmed, Advocate for the respondents, at length. They have raised so many contentions and argued this First Rent Appeal on merits as well as on law. Finally Mr. Malik does not press this appeal but requests for one year time to vacate the premises. He has tiled an undertaking in writing. Mr. Iqbal Ahmed, learned counsel for the respondents, has no objection if one year's time. is granted to the appellant. The following consent order is passed:‑

(1) The appeal is not pressed on merits.

(2) Appellant will hand over the vacant possession to the respondent on 30‑11, ` 1988. In case possession it not handed over, appellant shall be evicted without notice.

(3) Appellant should continue to deposit the rent on or before 10th of every month and respondent is at liberty to withdraw the rent from Rent Controller from time to time. In case of default in payment of rent as stated above, appellant shall be evicted without notice.

2. With the above consent order the appeal is disposed of with no order as to costs.
