ORDER

1. MUHAMMAD AFZAL ZULLAH, J.‑‑ The learned counsel states that this petition is by a pre‑emptor, who has not been able to obtain decree for pre‑emption at any stage of litigation before 31st of July, 1986. That being so, as held by this Court in the case of Sardar Ali and others v. Muhammad Ali and others P L D 1988 S C 287 no decree can be passed in favour of the petitioner for the first time after the said date. Leave to appeal is, therefore, refused and the petition is, accordingly, dismissed.

2. M.I./R‑52/S Petition dismissed.
