NIMATULLAH Versus GHULAM RASUL
ORDER
SAAD SAOOD JAN, J.โโ The only question for consideration in this petition for special leave to appeal is whether the respondents were tenants in the land in dispute. This is a question of fact and the findings of the Courts below are against the petitioner. It is, therefore, not a fit case for interference by this Court.
2. It is contended on behalf of the petitioner that there ha been tampering with the Revenue record and the local Patwari had furnished copies of the same khasra girdawari to the parties which varied in details. This may be so, but it is not for us to make any observation on this allegation. If the petitioner finds that the respondents obtained the judgment of the Court on the basis of forged documents, he may seek his remedy under section 12(2), Civil Procedure Code. This petition is without any merit and is hereby dismissed.
M.B.A./Nโ77/S Petition dismissed.
