MUHAMMAD SHARIF CHIRAGH DIN Versus PAKISTANA
ORDER
1. SAAD SAOOD JAN, J. ββThe petitioners filed a suit for a declaration inter alia to the effect that they had not entered into any contract with the respondent for the supply of fresh vegetables and onions to the latter. While this suit was pending, the respondent filed a suit against the petitioners for the recovery of Rs.10,32,808.74 as damages on account of the failure of the petitioners to abide by the contract. The petitioners moved an application that the proceedings in the suit filed by the respondent be stayed under section 10, Civil Procedure Code. The application was rejected by the trial Court whereupon they filed a revision petition in the High Court. A learned Single Judge in the High Court dismissed the revision petition. They now seek leave to appeal from this Court.
2. After hearing the learned counsel we are not satisfied that any case for interference by this Court with the order of the learned Single Judge has been made out. The petition is dismissed.
