SUPERINTENDENT OF POLICE, FAISALABAD Versus MUHAMMAD IQBAL

ORDER

1. GHULAM MUJADDID MIRZA, J. ‑‑The Superintendent of Police and two others have challenged the order of the Punjab Service Tribunal dated 14‑9‑1981 by means of this petition for special leave to appeal.

2. Muhammad Iqbal respondent who had been dismissed from service was reinstated by the. order of the Tribunal: The Tribunal further observed that as his conduct was not entirely unblemished he would not be eligible for any financial benefits for the period he remained out of service.

3. The main obstacle in the way of learned counsel for the petitioners was the following observation:‑

4. "We have also taken note of the order of the Superintendent of Police which is based on the order of the conviction passed by the Summary ,Military Court. When the order of the conviction had not been countersigned by the D.M.L.A. it amounted to setting aside the said order."

5. Learned counsel was unable to advance any effective argument to meet this. We don't think there is any Merit in this petition which is hereby dismissed.
