ORDER

SAAD SAOOD JAN, J.โ€‘โ€‘ This is a petition for special leave to appeal from the order dated 18โ€‘7โ€‘87 of the Lahore High Court whereby it refused to interfere with the order of the trial Court closing the evidence of the petitioner in a suit for specific performance of an agreement to sell brought by the respondents.

2. The evidence of the petitioner was closed on 14โ€‘6โ€‘87 by the trial Court with the following order: โ€‘--

3. When asked why the petitioner was not ready with his evidence on 14โ€‘6โ€‘87, all that the learned counsel stated was that he was not sure that the respondents whose counsel had died would be able to engage another counsel by that date. This can hardly be regarded as a satisfactory explanation. We do not think that this is a fit case where this Court should interfere. Leave is refused.

S.Q./Mโ€‘327/S Leave refused.
