ORDER

1. NASIM HASAN SHAH, J.‑‑ ‑This petition is directed against the judgment. of a Division Bench of the Lahore High Court dated 4‑6‑1985 passed in L.P.A.No.1 of 1969 whereby the matter was remitted to the learned Member, Board of Revenue/Chief Settlement Commissioner for entrustment to a competent notified officer for disposing of the revision petition of Zamir Ahmad Khan afresh, in accordance with law.

2. During the pendency of this petition for leave the competent notified officer has, however, heard the revision petition remitted to him by the L.PA. Bench and decided the matter afresh and the parties have again approached the High Court by filing Constitutional petitions against the said order. In these circumstances, this petition for leave to appeal appears to have become infructuous

3. Mr. A.R. Sheikh, learned counsel for the petitioner has, however, submitted that the order of the competent notified officer was largely influenced by the observations contained in the order of the learned Division Bench dated 4‑6‑1985. However, this aspect of the matter too can be agitated in the constitutional petitions now filed before the High Court and the said learned Court, we are confident, will decide the matter completely on its own merits in accordance with law.

4. This petition, with these observations, stands disposed of.

5. H.B.T./Z‑85/S Order accordingly.
