ABDUL MAJEED Versus THE STATE
ORDER
MUNIR A. SHEIKH, J.--- Leave to appeal Js sought against the judgment dated 22-10-1997 of the Lahore High Court through which the appeal filed by the petitioner against his conviction under section 304/34, P.P.C. and sentence of life imprisonment recorded and awarded by the trial Court through judgment dated 20-8-1994, has been dismissed.
2. According to the office report, this petition is barred by 47 days For reasons given in the application for condonation of delay, the delay is condoned.
3. According to the F.I.R., the incident took place in the month of February at about 3-4 a.m. in the night. As admitted by Muhammad Sharif/complainant i.e. the father of the deceased, his son had illicit relations with Robina, the sister of the present petitioner who went to the house of Malang, father of the petitioner and was murdered there.
4. Learned counsel for the petitioner has placed reliance on judgments reported as Zahid Parvez and another v. The State (PLD 1991 SC 575), Munir Ahmad v. The State (1994 SCMR 80), Ali Muhammad v. Ali Muhammad and others (PLD 1996 SC 274) and Kamal v. The State (PLD 1977 SC 153) to contend that the conviction and sentence awarded to the petitioner is not in accordance with the law declared by this Court in the facts and circumstances of this case.
5. Leave to appeal is granted to consider the question of quantum of sentence.
