ORDER

IRSAHD HASAN KHAN, J. ---This petition for leave to appeal is directed against the judgment, dated 4-8-1999, passed by a learned Single Judge of the Lahore High Court, Lahore in Civil Revision No. 1173 of 1999.

2. Brief facts are that the petitioners filed a suit for possession through pre-emption regarding the suit land. The trial Court by order, dated 7-7-1999, directed the petitioners to deposit Rs.16,33,334 towards Zar-e Soem. The petitioners challenged the same through a revision petition in the High Court on the ground that :he respondents have wrongly shown the value of the disputed land as Rs.39,00,000 instead of the probable value''" amounting to Rs.8,75,000, which was dismissed vide the impugned order.

3. We have heard the learned counsel for the petitioners. He does not press the petition on merits but contends that the order, dated 7-7-1999 passed by the learned trial Court requiring the petitioners to deposit Zar-e -Soem, could not be complied with, in that, the Civil Courts remained closed during the month of August, on account of summer vacation and there was A no Duty Judge available at Chunian.

4. In the interest of justice, the date for depositing the pre-emption amount, as determined by the trial Court, is extended for a period of one week from today. This is subject to all just exceptions.

5. With the above observation, the petition is disposed of.

H.B.T./A-198/S Order accordingly.
