ORDER

Muhammad Fazal, Excise Inspector laid trap near bus stand of Kharian on the basis of secret information received by him that a lady was travelling by a bus coming from Peshawar side with heroin in her possession. At 6 p.m. the petitioner Mst. Fatima resident of Kolian Shah Hussain Tehsil Kharian District Gujrat, came out of the bus which arrived from Peshawar side with a bag in her hand. She was searched and heroin 50 grams was recovered from her possession. 6 grams was taken out of it as sample for analysis by Chemical Examiner. The result from Chemical Examiner is still awaited. It, therefore, remains to be established that the commodity recovered from the petitioner was heroin. The petitioner's bail plea was declined by the lower Court, hence this application.

2. I have heard learned counsel for the petitioner as well as for the State and also perused the record.

3. Besides the fact that the petitioner is a woman, Report of Chemical Examiner that the commodity recovered from the petitioner was heroin is still awaited. In the circumstances I feel inclined to allow this petition, and direct that the petitioner be released on bail subject to her furnishing bail bonds in the sum of Rs.10,000 (ten thousand only) with two sureties each in the like amount to the satisfaction of Assistant Commissioner/ Duty Magistrate, Gujrat.
