Nisar Ahmad son of Ali Akbar, caste Jat Warraich, resident of Mangowal Sharqi, District Gujrat, was tried under section 307, P.P.C. for causing grievous hurt on the head of Sajjad, a minor boy son of Muhammad Aslam and nephew of Nazir Ahmad, complainant (P.W.3). Learned trial Court found him guilty under section 325, P.P.C. and sentenced him to five years R.I. and a fine of Rs.1,000. It was further directed that half of the amount of fine, if recovered shall be paid to Sajjad Ahmad the injured person, as compensation and the remaining half shall go to State Exchequer, vide judgment dated 1‑3‑1980. His sentence was suspended by this Court on 8‑4‑1980.

2 Today Nazir Ahmad complainant (Identity Card No.225‑27 293572) and also Muhammad Aslam (Identity Card No.225‑42‑2942731, father of the injured namely Sajjad and also Sajjad are present in Court, They stated that they have effected a compromise with Nisar Ahmad accused/ appellant. They have pardoned him, and that if he is acquitted they would have no objection.

3. The parties have compromised out of Court. They are present in Court today and pray for permission to compromise. In the interest of peace and good relations between the parties I grant necessary permission for compromise and consequently I accept the appeal under section 345, Cr.P.C. and setting aside his conviction and sentence, I acquit him. He is on bail. He is discharged from his bail bonds.
