SULTAN Versus THE STATE
ORDER
1. Briefly stated the facts of this case, which was registered ion, 6โ4โ1987 at the instance of Manzoor Ahmad complainant, are that afoul three month, prior to registration of the case, his wife Mst. Nazia was enticed by Sultan, Saif and Mohammad Idrees from his house. The accused were asked to restore Mst. Razia but with no result. After registration of the case, Mst. Razia was recovered from the house of Sultan petitioner by police. She was produced before a Magistrate for statement under section 164, Cr.P.C. on 15โ4โ1987. It was stated by her that she was forcibly abducted by Sultan petitioner, Saif and Idrees from her house. She was taken to village Paropian and kept there for about three months. She was raped by Idrees and Saif accused. The three accused named in F.I.R. are in judicial lock up. This is a petition for bail on behalf of Sultan accused only.
2. I have heard the learned counsel appearing for the parties. The F.I.R. was recorded after about three months of the occurrence on 14โ4โ1987 and she made statement before the Magistrate on 15-4-1987, There is no allegation that Sultan accused committed rape with her. In view of this, I admit Sultan accused petitioner to bail on is furnishing of bail bond in the sum of Rs.20,000 (Rupees twenty thousand) with one surety in the like amount to the satisfaction of A . C . I Duty Magistrate, Hafizabad.
