RABAZ AND 7 OTHERS Versus THE STATE

ORDER

The petitioners alongwith others are involved in a case under section 307/147/148/149 read with sections 379 and 411, P P C, arising out of F.I.R. No. 232, dated 5‑11‑1986 registered at Police Station, Murree. They have sought to be released on bail.

2. It has been alleged that the petitioners and their co‑accused who were armed variously launched a murderous assault on the complainant as well as on Irfan. Muhammad Rashid, Khalid, Khurshid, Talib Aussain and Muhammad Niaz, Rabaz, Mehrban, Muhammad Akhlaq and Mehtab allegedly fired with their respective guns causing injuries to Muhammad Naz. Reham Niwaz is alleged to have caused injuries with a gunshot to Khalid Mahmood. Muhammad Fazal allegedly fired a gunshot hitting Muhammad Rashid. Ziarat allegedly caused injuries to Khurshid with a gunshot. Razan has been ascribed no injury although he was allegedly armed with a hatchet at the time of occurrence.

3. The co‑accused in this case have already been released on bail. The injuries attributed to the petitioners are of simple nature. The parties have since compromised. In the circumstances, the petitioners are admitted to bail in the sum of Rs.20,000 (twenty thousand) each with one surety each in the like amount to the satisfaction of A.C., Murree.
