ORDER

Zia‑ul‑Hassan petitioner who is involved in a case under section 379, P.P. C . has .moved this petition for bail.

Case was registered on 8th February, 1982 on the written complaint of Abdur Rashid wherein he alleged that on 6th February, 1982 his motor‑cycle which had been parked in the compound of the office of the Director, T & T Accounts, was found missing. On 1st September, 1982 Sardar Ali, Sub‑Inspector, Police Station Zafarwal, recovered the motor‑cycle from co‑accused Nur Muhammad who disclosed that he had purchased it from the petitioner. Muhammad Nawaz, Investigating Officer, states that Nur Muhammad could not produce any receipt.

2. The petitioner was arrested on 17th March, 1983 and is in jail since then. The stolen property has already been recovered. In the circumstances, I admit him to bail in the sum of Rs.10,000 with two` sureties in the like amount to the satisfaction of Assistant Commissioner, Lahore City.
