TAJ MUHAMMAD Versus MUHAMMAD HUSSAIN

ORDER

This is an application for the suspension of sentence of Allah Bakhsh son of Khan Muhammad who alongwith others stands convicted under section 302/34, P.P.C. and sentenced to imprisonment for life plus fine by the learned Sessions Judge, Bhakkar vide his judgment dated 2‑6‑1988.

2. It is stated that the petitioner was empty‑handed and there is no allegation against him of having caused any injury to the deceased. It is further stated that there is a mention m the impugned judgment that he had conspired with his co‑accused for the murder of Zia Ullah deceased but there was no charge of conspiracy against him. Furthermore, three of the co‑accused namely Inayat Ullah, Habib Ullah and Zia Ullah son of Muhammad Afzal who were allegedly armed with gun and had taken direct part in the occurrence were given the benefit of doubt and acquitted.

3. In view of the above circumstances, I suspend the sentence of Allah Bakhsh petitioner and direct that he be released on bail on furnishing surety bonds in the sum of Rs.30,000 with two sureties in the like amount to the satisfaction of A.C., Bhakkar.
