ORDER

The petition is pressed on the plea of alibi. The two Investigators have found the petitioner to be not present at the spot during the occurrence. At the time of arrest he was recorded as 16/17 years of age. He was a student of 12th Class in the college during the days of occurrence and his certificate from

Government Higher Secondary School, Chak Jhumra, District Faisalabad, now produced at the Bar shows that he was born on 8-9-1975. The case diaries have been looked into.

In view of the fact that the petitioner was student, aged about 16 Years during the days of occurrence and his father and uncle, the co-accused, were having guns and so perhaps they only would have sufficed to fire the three effective shots upon the deceased. The case of the petitioner is of further allowed bail in the sum of Rs.50,000 with two sureties in the I inquiry. Hence like amount to the satisfaction of the trial Court.
