PAKISTAN INTERNATIONAL AIRLINES CORPORATION Versus SULTAN AHMED CHANDIO

This petition has been moved on behalfiof Karamat Ali and 2 others, praying for transfer of case titled "State v. Karamat Ali etc." pending in the Court of Magistrate 1st Class, Pattoki, on the ground that family of the complainant has good terms with well-known political family of late Rana Phool Khan and therefore, it is apprehended that the accused/petitioners would not get impartial trial in District Kasur.

2. Learned counsel appearing on behalf of the complainant/respondent No.2 says that he has no objection to the transfer of the case from the Court of Magistrate 1st Class, Pattoki but it should be entrusted to either a Court at Chunian or at Kasur. He further submitted that transfer of the case to another District would entail expenses, which would not be possible for the complainant/respondent to bear. Learned counsel for the petitioner proposes that the case be tried by a Court of competent jurisdiction at Lahore. Although learned counsel for the complainant/respondent does not agree to this proposal but I find it to be reasonable because the distance of Lahore is just equal to distance of Kasur and Chunian from Pattoki, therefore, there is no apprehension that the complainant/respondent would be burdened with exorbitant expenses. Learned counsel for State however, opposes the petition.

3. Be that as it may, since it is well-known principle of law that justice should not only be done but should be seem to have been done, therefore, in all fairness, I feel inclined to allow this petition. Consequently, the case mentioned above is hereby withdrawn from the Court of Mian Muhammad Wasim Ahmad, M.I.C., Pattoki and is hereby entrusted to Sh. Muhammad Masood, M.I.C., Lahore for disposal in accordance with law.
