ZUBAIDA BIBI Versus MUHAMMAD SARWAR

ORDER

Mst. Zubaida has filed this Constitutional petition for the registration of case against respondents Nos.1 to 3, police officials, respondents Nos.4 to 8 which includes respondent No.5, daughter-in-law of petitioner, respondent No-6, mother of respondent No.5, and respondent No.7, sister of respondent No.5.

2. The facts stated in the petition are that respondent No.5 is married to the son of petitioner and that the former in connivance with other respondents has committed theft of ornaments and cash of Rs.56,000 from her house. It is also stated that some domestic articles and other valuables have been removed, although the details are lacking in the petition. Petitioner protested against this but the respondents did not pay any heed to it rather caused illegal abortion of respondent No.3 who is daughter-in-law of the petitioner. Further states in the petition that for registering the case respondents Nos.1 to 3, police officials, demanded a sum of Rs.10,000 as illegal gratification and a sum of Rs.4,500 was paid. It is also stated that a sum of Rs.200 was paid to respondent No.3, Moharrir of Police.

3. Admittedly the parties are closely related to each other and in view of this learned counsel for petitioner was questioned as to why the alleged incident had happened but there was no explanation.

4. Learned counsel states that petitioner filed many applications to the police officials but without any action. Last application, according to learned counsel, was filed on 20-4-1993. If, on the facts and circumstances of the case, the police is not taking any action, alternate remedy is available to the petitioner by filing a private complaint whereupon the same will be decided by the competent Court as expeditiously as possible.

Disposed of.
