MST. EJAZ BIBI Versus S.H.O.

Mst. Ejaz Bibi and Lai Muhammad seek quashment of F.I.R. No.510, dated 21-10-1993 under section 10/11, Offence of Zina (E.H.O.) Ordinance, 1979, Police Station Bahawana, District Jhang registered at the instance of Dosa, father bf Mst. Ejaz Bibi petitioner.

2. The relevant facts are that Dosa got the above-noted case registered on the allegations that Lai Muhammad petitioner and others had abducted his daughter Mst. Ejaz Bibi, aged 15/16 years and had also taken away ornaments and cash. They had been making promises for her restoration but later on " backed out.

3. The petitioners' contention is that Mst. Ejaz Bibi being sui juris had voluntarily married with Lai Muhammad against the wishes of her father and that she had got her statement recorded before the Resident Magistrate, Pindi Bhatian to the above effect.

4. The case of which the quashment is sought is said to be still under investigation. The petitioners can appear before the Investigating Officer and put forth their version,, but it would be unfair to deprive Dosa of producing material before the police in support of his version. After recording the evidence of both the parties, the police may come to any finding but before the completion of evidence, I do not consider it proper to interfere in the matter at this stage. Accordingly, the petition is dismissed.
