ORDER

I have recorded the statements of the aforesaid detenus and the S.H.O., Police Station Baigowala. From the report of Bailiff and statements of .he detenus one thing is clear that the detenus were found in illegal confinement of respondent No.l, the aforesaid S.H.O., hence they are admitted to ad interim pre-arrest bail till 13-4-1994, provided they furnish bail bond in the sum of Rs.1,000 (Rupees one thousand only) with one 'surety each in the like amount to the satisfaction of the Deputy Registrar (Judicial) of this Court.

2. Meanwhile, the copies of all the statements as well as signed copies of the Police Zimnis be sent to S.S.P., Sialkot for taking appropriate E departmental/legal action against the delinquents Police Officers/officials. The S.S.P., Sialkot is directed to get the case registered against Javid Aslam, S.H.O., Police Station Baigowala on the application of the petitioner or the detenus under the relevant law. If the case is registered then he should be placed under suspension immediately, so that the Police Officer may not influence the investigation of the case. The investigation of the case should be entrusted to some independent/honest. D.S.P., Sialkot who should record the statements of Bailiff, the detenus and other persons and submit the challan in the Court. Pending the proceedings against the aforesaid S.H.O., he should not be posted as S.H.O. in any police station of this District.

3. The learned counsel for the petitioner has brought this fact to my notice that none of the Zimnis was shown to the Bailiff when he raided the said police station and this fact is confirmed by the Bailiff of this Court.

4. For further proceedings case to come up on 13-4-1994. On the aforesaid date D.S.P. should appear in this Court alongwith record.
