ORDER

This Constitutional petition was filed by Shah Baig against the Police of Police Station Bhowana, Tehsil Chiniot and some police officials of C.I.A. Chiniot with the grievance that the respondents entered in his house, abused and manhandled the inmates of the house including the ladies, and forcibly took away the golden ornaments weighing 5-1/2 Tolas and he approached the police-respondent No.1 for getting the case registered but he refused to do so. .

2. A report was called for from S.H.O./respondent No.2 in this case vide order, dated 28-10-1992 which has been received. It has been reported against paragraph No.3 of the petition that neither the petitioner had approached the answering respondent and nor his application had been received at the police station for legal action in the matter. If he had approached D.S.P., Chiniot, some order would have been received at the police station from the officer. He also reported that if the petitioner had approached the answering respondent a legal action would have been taken in the matter.

3. In view of this report of the answering respondent, I direct that the petitioner if approached S.H.O. Police Station Bhowana, Tehsil Chiniot, (respondent No.2) with his grievance in writing and if a commission of cognizable offence was made out he shall register the case and after that shall proceed in accordance with law.

4. With this observation, this petition is disposed of.
