ORDER

Seeks post-arrest bail in case F.I.R. No.314 of 2004, dated 3-4-2004 under sections 17/22 of E.O., 1979 registered at Police Station F.I.A., P.C., Lahore.

2. In brief the allegation against the petitioner is that he had received Rs.50,000 from the complainant party on the pretext of sending Muhammad Ashraf (son of the complainant) abroad for employment.

Allegedly the said commitment was never honoured nor the disputed amount has been returned.

Petitioner was arrested in this case on 7-4-2004. Bail of the petitioner was dismissed by Special Judge (Central), Lahore vide order dated 13-5-2004, hence this petition.

3. Heard. File perused.

4. No doubt evidence of Muhammad Ashraf, Muhammad Waris and Muhammad Zaman reveals that petitioner had received the disputed amount on different occasions on the pretext of sending Muhammad Ashraf (son of the complainant) abroad but these statements are absolutely silent with regard to time, date and year when the amount in dispute was allegedly paid to the petitioner. During the investigation nothing was recovered from the petitioner who is behind the bars for the last more than three months and no more required for any further, investigation. Similarly till today challan in this case has not yet been submitted by the agency. In this view of the matter, this petition is allowed and petitioner is admitted to bail subject to his furnishing bail bonds amounting to Rs.50,000 (Rupees fifty thousand) with one surety in the like amount to the satisfaction of the trial Court.
