ORDER

1. This is an application by the complainant. One Jan Muhammad son of Ata Muhammad who filed a complaint in the Court of the Additional District Magistrate, Jacobabad on 10‑11‑1971. The case pertain to Kashmore to which place all the parties and the witnesses belong but by reason of the fact that there is no Magistrate on this place the complaint necessarily had to be filed at Jacobabad for disposal but although the precise details have not been brought on the record it does seem clear from the order of the D . M . Jacobabad that no substantial progress has been made in the case although the case has been pending for a long time.

2. The distance of Kashmore from Jacobabad is about 100 miles and the nearest place from Kashmore is Kandkot which is about 30' miles from it. The fact that the parties and the witnesses belong to Kashmore is admitted and respondent No. 2, who is the accused, although served has not appeared to oppose this application. The learned Additional Advocate‑General states that in view of the obvious general convenience of the parties it would be desirable to transfer this case to Kandkot and I agree with him. This case, therefore, be transferred to the Court of the Civil Judge and F.C.M. Kandkot.
