SALMAN KHALID Versus STATE

ORDER

1. Applicants Malik Salman Khalid, Minhas Khattak and Muhammad Afzal are detained in Crime No.390/93, registered at Police Station SITE, Karachi on 5-12-1993 under sections 408, 420, 34, P.P.C. read with section 17(3) of Offences Against Property (EOH) Ordinance, 1979. Bail application moved on behalf of the applicants in the trial Court of IIIrd Additional Sessions Judge West, Karachi, is dismissed on 26-2-1994.

2. I had dealt with the bail application of co-accused Iqbal Ahmed Paracha and Jamil Ahmed Paracha (Criminal Bail Application No.183 of 1994) and had given detailed reasons for grant of bail and had also referred to the facts of the case.

3. I have heard the appellants' learned Advocate and the counsel appearing for the State. The latter has not opposed this application. The I.O., who is present in Court has also been heard and he states that it was at the pointing of these applicants that the tea allegedly robbed from the Trailer of the complainant was recovered from the godown of the accused Iqbal Ahmed Paracha and Jamil Ahmed Paracha. The I.O. further states that some more accused, who have gone away to the Frontier Province are still to be arrested. The only evidence, as it is evident from the record, against these applicants is that a portion of the tea allegedly robbed from the employees of the complainant, was sold by them to the accused Iqbal Ahmed Paracha and Jamil Ahmed Paracha, from whose godown it was subsequently recovered. But Iqbal Ahmed and Jamil Ahmed have been granted bail. The case of the applicants, in my view, also requires further enquiry and I am inclined to grant them bail. They shall be so released on their furnishing one surety each in the sum of Rs.25,000 (Rupees twenty-five thousand) with P.R. bond in the like amount to the satisfaction of the learned trial Court.
