ORDER

Applicant Muhammad Yousuf alias Yousuf Bangali who is detained in Crime No.12/1993 under Articles 3 and 4, Prohibition (Enforcement of Hadd) Order, 1979 has approached this Court for bail after a similar application moved on his behalf is rejected by the learned VIth Additional Sessions Judge (South), Karachi on 6-11-1993. Co-accused in the case is one Muhammad Saeed from whom 40 grams of heroin powder was recovered. From the applicant herein, heroin powder weighing 4.980 (net) was recovered.

2. I have heard the learned counsel for the applicant and the A.A.-G. I have also perused my order, dated 10-9-1993 whereby bail was allowed to co accused Muhammad Saeed. The learned A.A.-G. frankly conceded that the case of applicant Muhammad Yousuf is on better footings than the case of co-accused Muhammad Saeed whom bail has been granted and he has therefore, no objection if bail is allowed to applicant. For the reasons already given by me in deciding the bail application of co-accused Muhammad Saeed (Criminal Bail Application No.851 of 1993) I am inclined to grant bail to the applicant herein. He shall be so released if he furnished one surety in the sum of Rs.50,000 with P.R. bond in the like amount to the satisfaction of the trial Court.
