KH. MUHAMMAD YOUSAF (MEMBER). --Mushtaq Ahmad, ex- constable No.2320 of District Police, Lahore has filed the present appeal under section 4 of the Punjab Service Tribunals Act, 1974 against his dismissal from service and has impleaded the Superintendent of Police, Headquarters, Lahore and Inspector General of Police, Punjab, Lahore as respondents.

Briefly stated the facts of the case are that the appellant absented himself from duty without permission or leave from competent authority for the period from 24-6-1984 to 15-7-1984, 28-7-1984 to 27-8-1984 and 4-9-1984 to 7-10-1984 and continued his absence for about 2 months. Consequently the appellant was served with a show- cause notice under Rule 6(3) of the Punjab Police (E & D) Rules, 1975, by the S.P. Headquarters, Lahore for major penalty. The appellant was dismissed by the S.P. vide his order dated 7-10-1984. The appellant then preferred an appeal to the D.I.G. Police which was also dismissed. The appellant then filed appeal before the Inspector General of Police, Punjab, Lahore which was also dismissed by the I.G. vide his order dated 4-8-1986. The appellant then filed the present appeal before this Tribunal on 4-9-1986.

3. We have gone through the record of this case and heard the learned counsel for the appellant at length. We are of the considered) opinion that the appeal of the appellant has no merits. The appellant is established to have remained absent for a period of about 2 months and has not shown any plausible reason for his absence to the respondents or to this Tribunal. The appellant being member of the disciplined force cannot be tolerated to absent from duty without leave or permission from the competent authority.

4. In our opinion the appeal of the appellant has no force and is dismissed in limine.
