MUHAMMAD YAQOOB Versus M/s INDUS TEXTILE MILLS LTD.
DECISION
This is an appeal filed by the appellant against an impugned order, dated 10‑9‑1986, passed by the Sind Labour Court No.VI Hyderabad, who had dismissed the grievance petition of the appellant under section 25‑A, I. 8.0.1969.
2. Brief facts of the case are that the appellant's services were terminated vide order, dated 16‑10‑1984, but it was withdrawn on 12‑11‑1984 and again were terminated on 29‑I1‑1984. Being aggrieved with this termination order, the appellant claimed that he wrongly approached the Civil Court and which civil suit was dismissed on 29‑11‑1985. Thereafter, the appellant claimed that he was handed over the papers by his Advocate on 5‑1‑1986, therefore, the time for computing the limitation in respect of wrong forum was prayed to be excluded at the time of deciding his grievance petition under section 'ls‑.A, I.R.O. 1969.
3. However, the learned Labour Court after considering the facts and circumstances of the case has passed the impugned order dismissing the grievance petition of the appellant holding it to, be hopelessly time‑barred, hence, the present appeal.
4. Today when the appeal was called for hearing, nemo was present on behalf of the appellant. I have gone through the impugned order. There is nothing wrong with it. I would, therefore, maintain the impugned order and would dismiss this appeal in limine.
