DECISION

1. Heard Mr. Muhammad Yousuf Khan, Advocate for the appellant.

2. It appears that there was a settlement arrived at between the parties, according to which any employee of the Department who had worked on a particular post for six years was to be made permanent at the job. However, the benefits of this settlement could not be invoked by the appellant, as there is not even a shred of paper to show that they had at any time been promoted or officiated as Traffic Assistants. On the other hand they had admitted in cross examination that they were appointed as Conductors in Grade‑III and they had never been given any written orders promoting them as Traffic Assistant in Grade‑V. It was also admitted by them that they had never received the pay of Traffic Assistants. There is also no evidence that any of the appellants had worked as Traffic Assistant for six years or more. Even TT‑23 which could throw fight on the matter is not forthcoming.

2. In this state of the record no purpose will be served by admitting the appeals. I will uphold the impugned orders and dismiss all the appeals in limine by this common decision.
