DECISION

Heard. Mr. Abdul Hafeez, Advocate for the informant.

The case has been pending before the Labour Court for a number of years. The record which I had sent for, shows that on the application of the informant, though opposed, "additional evidence" was allowed by the Labour Court to bring the Seniority List on the record.

2. The matter was then fixed for arguments.

3. Later on another application was again filed before the Labour Court asking for further documents to be brought on the record. The contention raised from the other side was that it was nothing but a belated attempt to improve upon the informant's case. Fears were also expressed about, their genuineness.

4. Be that as it may, the jurisdiction under section 38(3‑A), I.R.O. cannot be invoked as a matter of right. The Tribunal will on its own motion, if so satisfied, can look into the correctness, the legality or propriety of an order which is brought to its notice. .

5. Manifestly the informant had been given the opportunity to present their case before it even on a belated application. If they failed to do so, they have to blame themselves. No premium can be placed on their lethargy and sloth. There is no merit in the application. I will therefore dismiss it in limine.
