SHAHMURAD SUGAR MILLS LTD., DISTRICT THATTA Versus GHULAM MUSTAFA

DECISION

This appeal arises from an order of the VIth Sindh Labour Court, Hyderabad allowing the grievance petition of worker Ghulam Mustafa for re instatement and back benefits.

2. The Katcha Peshi was fixed for 15‑1‑1996 but Mr. Races Mushtaq, Advocate for appellant Sugar Mills remained absent on the ground that he was busy before the High Court. The matter was, therefore, adjourned for a month to 12‑2‑1996. On this date also Mr. Races Mushtaq has sent an application for adjournment on the same ground. If Mr. Races Mushtaq could not appear himself, he should have arranged appearance.

3. I have gone through .the judgment of the Labour Court and also the Memo. of appeal filed by Mr. Races Mushtaq. The grounds of appeal on half a page are general and vague and no specific ground has been mentioned against the judgment. I find that non‑employment of respondent Ghulam Mustafa at the Sugar Mills for the crushing season 1993 to 1994 was not justified. He was entitled to re‑employment under the law as held by the Labour Court.

4. The order of the Labour Court is accordingly maintained and this appeal is dismissed in limine.
