MUHAMMAD MURTAZA Versus PROVINCE OF SINDH through Chief Secretary, Government of Sindh

ORDER

1. ADNAN-UL-KARIM MEMON, J .----Petitioner claims his appointment against deceased quota in Police Department, Government of Sindh.

2. Case of the petitioner is that his father late Abdul Sattar was serving as Sub-Inspector at Police Training College Shahdadpur District Sanghar and expired during service on 6.3.1999. The petitioner moved an application to respondent No.2 for his appointment on deceased quota but all in vain, hence he has filed the instant petition.

3. Upon notice, the respondent Deputy Inspector General of Police Training Sindh Karachi has endorsed the assertion of the petitioner in his comments in the following terms:

"In the light of above mentioned disclosing facts and circumstances, it is established that the petitioner case falls in purview of deceased quota under the provisions of Rules 11-A of Sindh Civil Servant (APT) Rules, subject to approval by the committee constituted at CPO level, petitioner will be appointed against deceased quota by his concern Range DIGP as per his district of domicile.

5. In the light of above facts and circumstances of the case, the instant Petition stands disposed of directing Chief Secretary to Government of Sindh to consider the case of the Petitioner for his appointment on any post against deceased quota as per his qualification on the basis of Rule 11-A of Sindh Civil Servants (Appointment, Promotion and Transfer) Rules, 1974 and in accordance with the dicta laid down by Honorable Supreme Court of Pakistan in C.Ps. Nos.482-K and 503-K of 2016, within a period of two months from the date of receipt of this order.

6. Let a copy of this order be communicated to the Respondents for information and compliance.
