MUHAMMAD YAQOOB ABDULLAH Versus THE STATE
ORDERMUHAMMAD NASEEM, J.- On the basis of the registration of ca / No. 552 dated 29.11.1989 under Section 409 PPC at Police Station 13- Division, Sahaiwal Muhammad Yaqoob Abdullah petitioner is being tried by the learned Special Judge, Anti-Corruption Multan. An application has been filed by the petitioner under Section 249-A Cr.P.C'on 12.10.1993 for his acquittal which has not been disposed of by the learned Trial Court. Feeling aggrieved he has invoked the extraordinary jurisdiction of this Court under Section 561-A Cr.P.C, for quashment of the proceedings.
2.My view is that after the submission of the challan and during the pendency of the application filed under Section 249-A Cr.P.C; this application for the quashment of the proceedings is not maintainable.
3.However, it is the right of the petitioner to get disposed of theapplication filed by him under Section 249-A Cr.P.C, either way within a reasonable time. The learned Trial Court is directed to dispose of the aforesaid application, if pending, within a period of 60 days from today either way without feeling prejudiced by this order.
4.With my aforesaid observation this petition stands disposed of.
